RestoCAP Terms & Conditions
Effective Date: October 26, 2026 | Version: 2026-10-v3 | Status: Operational Draft
1. Introduction and Acceptance
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (whether personally or on behalf of an entity, “Customer”, “Restaurant Operator”, or “You”) and RestoCAP (“Platform”, “We”, “Us”, or “Our”).
By creating an account, accessing our website, subscribing to a software plan, or permitting dining guests to scan RestoCAP table QR codes, you expressly agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue access and use of the platform.
2. Definitions
- “RestoCAP SaaS Platform”: The multi-tenant cloud software, web applications, APIs, Kitchen Display System (KDS), cashier counter terminals, and customer QR ordering interfaces provided by RestoCAP.
- “Restaurant Operator” / “Subscriber”: The business entity, owner, or authorized manager subscribing to RestoCAP to manage culinary and hospitality operations.
- “Dining Guest” / “End Customer”: A diner who scans a QR code at a restaurant table or visits the digital menu to place food orders or call for service.
- “Subscription Plan”: Tiered commercial access packages (Starter, Growth, Business) conferring entitlements for branches, tables, menu catalog size, and features.
- “Offline Settlement”: Direct payment collection between the restaurant and diners (cash, merchant UPI standee, bank POS) independent of SaaS subscription fees.
3. Scope of the Service
RestoCAP provides digital operational infrastructure designed to coordinate hospitality workflows:
- Multilingual customer digital QR menu presentation and order ticket generation.
- Real-time Kitchen Display System (KDS) order routing and prep lifecycle tracking.
- Audible voice announcements in English and Hindi for order intakes and service ready alerts.
- Front-of-house cashier bill presentation, tax calculation, and payment status recording.
- Staff table assistance call queue and customer loyalty ledger tools.
Note: RestoCAP is a software technology provider. We are not a food delivery aggregator, culinary kitchen, or licensed food business operator (FBO).
4. Restaurant Responsibilities
Restaurant Operators remain solely responsible for:
- Statutory food safety certifications, including active FSSAI registration and hygiene standards.
- Accuracy of all menu item names, descriptions, allergens, dietary flags (Veg / Non-Veg), and ingredient notices uploaded to the platform.
- Ensuring all kitchen tablets, cashier computers, and counter soundboxes have reliable power and internet connectivity during service.
- Timely physical preparation and table delivery of ordered food and beverages.
- Handling diner disputes, food quality questions, and table complaints on-site.
5. Customer Ordering
Diners access digital menus by scanning an authoritative table QR code. Dining guests are not required to create permanent accounts or provide sensitive personal credentials to view prices or place orders.
Guest session tokens are stored ephemerally in the guest’s browser session storage to maintain active cart state and track order progress. Orders submitted via QR codes are authoritative commitments transmitted directly to the kitchen queue.
6. Order Acceptance and Fulfilment
A customer order is received in the “new” status upon transmission. Kitchen staff acknowledge orders by advancing tickets through defined stages:
The restaurant reserves the right to reject or cancel an order ticket if kitchen ingredients are depleted or if unresolvable preparation conflicts arise, upon prompt notification to the guest.
7. Menu Prices, Taxes and Availability
All menu dish prices, applicable Goods and Services Tax (GST) rates, and discretionary service charges are configured authoritatively by the restaurant operator via the manager console.
Operators may mark dishes as sold-out (86’d) in real time to prevent further customer ordering. RestoCAP does not mark up food prices or levy hidden diner surcharges.
8. Payment Processing and Settlement
A. Dining Room Food Bill Settlement (Restaurant & Guests)
Diners settle food bills directly with the restaurant at the table or counter using cash, bank POS machines, or the restaurant’s own merchant UPI standee. RestoCAP acts solely as a digital recording tool. We do not intermediate, escrow, or charge commissions on diner food sales. Cashier staff verify settlement by checking physical cash tender or bank soundbox alerts prior to marking bills settled in the system.
B. RestoCAP SaaS Subscription Payments (Static Paytm/UPI QR Flow)
RestoCAP software subscription fees are paid through our direct static merchant Paytm/UPI QR code workflow. We do not use automated payment gateways, third-party card auto-debit aggregators, or automated bank webhooks for subscription billing.
- Verified Merchant Credentials: Payments must only be sent to our verified merchant UPI ID:
restocap.in@ptyes(Merchant Payee: RestoCAP / Abhishek Jaiswal) using the static Paytm QR code displayed at checkout. - Submission of UTR: After transferring the exact plan amount, the subscriber submits their 12-digit Bank Unique Transaction Reference (UTR).
- Pending Verification State: The subscription claim is immediately logged with status “Pending Verification”. Submitting a transaction reference does not automatically activate software entitlements.
- Manual Bank Verification: An authorized platform administrator manually verifies receipt of the exact funds against official merchant bank statements before confirming or rejecting the claim.
- Duplicate Prevention: Transaction references are unique. Submitting a duplicate or previously processed UTR will be rejected.
- Audit Trail: Once verified, an immutable payment receipt is recorded and subscription entitlements are activated for the paid term.
9. Cancellation, Refund and Dispute Handling
Operators may cancel their SaaS subscription renewals at any time via the manager console or by notifying support at support@restocap.app. Subscription access remains active through the end of the paid billing period.
Subscription fees paid for an active, delivered billing cycle are non-refundable. For first-time annual plan subscribers, we offer a 7-day money-back guarantee if the software fails to deliver advertised plan entitlements, subject to written request and administrative review.
10. Account Security and Acceptable Use
Subscribers must protect console login credentials and limit administrative roles (Owner, Manager) to authorized personnel. Subscribers agree not to:
- Reverse-engineer, decompile, or copy RestoCAP proprietary software or audio engines.
- Submit abusive, fraudulent, or defamatory content through customer review interfaces.
- Attempt to bypass Row-Level Security, multi-tenant boundaries, or plan entitlement gates.
- Use automated bots or scripts to scrape pricing data or disrupt platform availability.
11. Service Availability and Technical Limitations
RestoCAP strives for continuous platform availability using redundant cloud infrastructure. However, subscribers acknowledge inherent technical limitations:
- Local Network Disconnection: In the event of Wi-Fi or cellular loss, hardware terminals rely on offline cash drawers and manual ticket pads until connection restores.
- Browser Speech Autoplay Restrictions: Web Audio and speech synthesis on kitchen tablets require an initial user screen tap on device boot to satisfy browser security policies.
- Maintenance Windows: Scheduled maintenance will be announced with advance notice where feasible.
12. Privacy and Data Handling
RestoCAP handles operator business records and diner order details in strict compliance with our Privacy Policy and applicable data protection laws. Every restaurant tenant’s data is strictly partitioned via PostgreSQL Row-Level Security.
13. Third-Party Services
RestoCAP coordinates with vetted infrastructure partners, including Supabase (PostgreSQL database hosting and realtime websockets) and transactional email providers. We do not sell, rent, or broker customer data to third-party ad networks.
14. Intellectual Property
All software code, user interface designs, audio synthesizers, algorithms, trademarks, and branding associated with RestoCAP are the exclusive intellectual property of RestoCAP and its founder. Subscribers retain ownership of their restaurant logos, trade names, and uploaded menu photography.
15. Liability and Disclaimers
RestoCAP is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, RestoCAP disclaims all warranties of any kind, whether express or implied.
In no event shall RestoCAP be liable for indirect, incidental, special, or consequential damages, including lost restaurant revenue or inventory spoilage, arising from temporary service interruptions or hardware printer errors.
16. Suspension and Termination
RestoCAP reserves the right to suspend or terminate subscriber access in cases of material breach of these Terms, failure to remediate unpaid subscription balances after notice, or verified fraudulent or unlawful conduct.
17. Amendments and Version History
We may revise these Terms from time to time to reflect product updates or legal requirements. Material revisions will be posted on this page with an updated version number and effective date. Continued use of the service following publication constitutes acceptance of the amended terms.
